Terms of Service

The Services relate to premium cigars and tobacco-adjacent products. You must be at least twenty-one (21) years of age (or the legal age to purchase or possess tobacco products in your jurisdiction, whichever is greater) to create an account or use the Services. By using the Services, you represent and warrant that you meet this age requirement and that all registration information you submit is accurate and complete.

Some features of the Services require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us promptly at cigarlink@radol.net of any unauthorized use of your account or any other breach of security.

Subject to your compliance with these Terms, Radol grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, solely for your personal, non-commercial use. All rights not expressly granted are reserved.

You agree not to, and not to permit any third party to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services, except to the extent applicable law expressly permits.
• Interfere with or disrupt the integrity, performance, or security of the Services.
• Use the Services to send unsolicited messages, advertising, or other unauthorized content.
• Misrepresent your identity or affiliation, including by impersonating any person or entity.
• Scrape, harvest, or collect data from the Services other than as expressly permitted.

You retain ownership of any content you submit to the Services (“User Content”). By submitting User Content, you grant Radol a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and improving the Services. You represent that you have all rights necessary to grant this license and that your User Content does not violate any law or third-party right.

The Services, including all software, text, graphics, logos, and trademarks, are owned by Radol or its licensors and are protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use Radol’s trademarks, logos, or brand features without our prior written consent.

The Services may include links to, or interoperate with, third-party websites and services that Radol does not control. We are not responsible for the content, policies, or practices of any third-party service, and your use of such services is at your own risk.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Radol DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL RADOL, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services will cease immediately. Sections that by their nature should survive termination shall survive, including ownership, disclaimers, limitations of liability, and governing law.

If you download the App from the Apple App Store, you acknowledge and agree that these Terms are between you and Radol only, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple will have no other warranty obligation. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

We may update these Terms from time to time. If we make material changes, we will notify you by updating the Effective Date above and, where appropriate, providing additional notice through the Services. Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Florida, United States of America, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Florida, United States of America, and you consent to the personal jurisdiction of such courts.
